Emergency commissions are open (to help cover a friend's dad cancer treatment). all money goes directly to his family!! please be mindful that i do have a queue and any commissions taken will be last on it, so I may take a while to start them !Please note that these prices are only referential and they may increase depending on the piece's complexity.All commissions are fully rendered and include a simple background. The price for more complex backgrounds changes from piece to piece, so a clear description or reference pictures will be needed to set it.Most of these examples are pieces with backgrounds, so they were more expensive than the base price! if you want a background similar to one of these specifically, you can tell me and it will be easier to set a quotation for you:)

Terms and Conditions

I. General Terms

All communication is to be done via direct message of the client’s choosing (Twitter DM, Instagram DM, or Discord).Clear visual references are required preferred for all commissions, such as pictures and reference sheets. You may include textual descriptions for poses and expressions, but it is preferred if you gave other visual references of these as well. If no clear visual reference is provided, the piece will be treated as a character design commission and priced as such.

II. Payment

All payments will be made in USD, through a PayPal.me link, except for chilean clients, who can pay via bank transfer.
Payments must be made in full, up front, before I can begin work on your commission. Failure to complete the payment in a maxium of two days will forfeit your commission slot.They payment may be held by PayPal, and the funds would be unaccesible to me and there's nothing I can do to change that but wait until they're available, so if this happens you can either wait until they are released (may take from one to four weeks) for me to start working on your piece, or request a refund, losing your commission slot.

III. Progress Updates

Commissions will be placed into an ordered queue, with the first commissions to be accepted, becoming the first to be worked on, as well. Due to the time available to me changing every month, I cannot accurately place timeframes on how long a commission will take. It may be as soon as a few weeks, and as late as a couple months or more, depending on my queue, my schedule, and the complexity of the commissioned piece.If your commission has a specific deadline (for a birthday gift, or some other special occasion), then this must be discussed prior to paying for your commission, as I can charge an additional fee in order to move it up on the queue and complete it on time.
You will receive updates on the state of your piece when stages such as sketch, base colors and rendering are complete**. You may ask for updates whenever you want, but please be patient as I'm not logged on social media all day, every day.

** This does not apply for icon or simple furry pieces. Due to their simplicity and price, there won't be any updates until they are done

IV. Customer Satisfaction

I will do my best to correct mistakes made and be as transparent as possible with my clients about the process and state of their commission.The progress updates will allow for some revisions to be made, if requested:
During the sketch phase, you may request up to 2 free revisions, with the third and beyond incurring a revision fee. A complete do-over of the sketch I provide will incur a more substantial fee, which may vary depending on the complexity of the piece.
During the coloring and rendering phase, any revision that requires me to completely redraw parts of the work will incur a revision fee. Color changes and minor adjustments will be free.

V. Usage & Copyright

I, Anyi, hold all rights to the commissioned work itself; meaning that I, as the copyright holder, am allowed to:

  • Use the work in public spaces for the purpose of self-promotion.

  • Post the work on public galleries and social media sites.

  • Claim ownership of the work itself.

  • Include the work in art books or packs that may be sold for profit.

  • Use the work for making merch such as prints, stickers, etc, only if the commissioned work is fanart. This doesn't apply for commissons depicting original characters or real people.

You, the client, are allowed to:

  • Print and display the work for personal use only, unless contractually agreed otherwise.

  • Claim rights to the character depicted in the work, but not the work itself.

  • Use the work for self-promotion, to post on public spaces as they desire, but only with proper credit given to the original artist (Anyi).

Breaking these terms of service will result in your personal use license of the work to be revoked, and possible blacklisting from further service.Examples of copyright infringement are as follows:

  • Reproducing and using the copyrighted work for commercial purposes without a commercial license. (Simply put, selling the piece as a print or merch in any way, without permission.)

  • Wrongfully taking credit for the creation of the work itself.

  • Removing any watermarks/signatures from the work.

  • Creating unauthorized edits of the work.

Commercial licenses may be provided for a one-time fee of a % of the original commission cost based on how they will be used.The tiers of commercial use as well as what they apply to are as follows:Commercial Use A: Promotional material linked to commercial purposes (logos, emotes, online shop assets, YouTube thumbnails, etc)
Commercial Use B: Merchandise where the art is not the main focus (book cover, game assets, etc)
Commercial Use C: Merchandise where the art is the main focus (charms, stickers, t-shirt designs, event poster artwork, etc)The prices for the above commercial use tiers will be as follows:Commercial Use A: + %50 of total
Commercial Use B:+ %100 of total
Commercial Use C:+ %150 of totalFeel free to message me if you would like to purchase
commercial rights of your commission after it has been completed.Please note, this does NOT allow you to claim credit for the original work, you will still be required to credit the original artist (Anyi), even if it has been altered or edited in some way.As an added note, all of my works, commissioned or otherwise, are expressly forbidden from being minted as NFTs (Non-Fungible Tokens) or other such digital commodities on cryptocurrency blockchains. A commercial-use license does not include the right to do this.

VI. Canceling & Refunds

Please note that I, the artist, retain the right to cancel and refund the commission at any point in time for one reason or another. I will always refund your commission in full (including tips) if I cannot complete it.You, the client, do NOT have the ability to cancel or request a full refund once you have agreed to these conditions and paid for the piece.If the commission has not yet been completed after more than three month’s time, you may request a refund on that basis, but ONLY if the image has not yet been completed. If a commission’s sketch phase has been approved and set up for painting, then you will only receive a 50% refund. If the coloring phase has been approved, you will receive a 30% refund. Refunds will not be given for any reason once a piece is considered “finished”, meaning, the rendering has been completed.Any refunds will be processed when it is financially viable for me to do so; even if I approve a request for a refund, please be patient if it takes some time.Attempted chargebacks will mean you lose the right to your commissioned work, and said work will be repurposed for another commission or personal piece. The chargeback will be disputed with PayPal, and you will be blacklisted from future commission work from me. I may also, at my discretion, opt to warn other artists and encourage them not to take further commission work from you.

VII. Other

For pricing information check the **Examples and Prices ** page. All prices are subject to change at any time and are not negotiable to go lower. These prices are only referential and the final price will depend on the complexity of the piece and how close the deadline is.These terms and conditions can be adjusted based on the nature of the commission and can be discussed via DMIf you do not wish for the commission to be posted on social media, please let me know in advance.

Términos y condiciones

I. Términos Generales

Toda la comunicación debe realizarse a través de un mensaje directo a elección del cliente (Twitter DM, Instagram DM o Discord).Se requieren referencias visuales claras para todos los encargos, como fotografías y hojas de referencia. Puede incluir descripciones textuales para poses y expresiones, pero es preferible que proporcione también otras referencias visuales de estas. Si no se proporciona una referencia visual clara, la pieza se tratará como una comisión de diseño de personajes y se le asignará un precio como tal.

II. Pago

Todos los pagos se realizarán en USD, a través de un enlace de PayPal.me, excepto para clientes chilenos, que pueden pagar mediante transferencia bancaria.
Los pagos deben hacerse en su totalidad, por adelantado, antes de que pueda comenzar a trabajar el encargo. Si no se completa el pago en un máximo de dos días, perderá su slot.Es posible que PayPal retenga el pago, lo que está fuera de mi control. Si esto sucede, puedes esperar hasta que se liberen los fondos (puede tomar de una a cuatro semanas) para que yo comience a trabajar en su pieza, o puedes solicitar un reembolso, perdiendo su slot.

III. Actualizaciones de progreso

Los encargos se colocarán en una cola ordenada, y las primeras comisiones que se acepten se convertirán también en las primeras en las que se trabajará. Debido a que el tiempo disponible para mí cambia cada mes, no puedo establecer con precisión los plazos sobre cuánto tiempo tomará una comisión. Puede ser tan pronto como unas pocas semanas y tan tarde como un par de meses o más, dependiendo de mi cola, mi horario y la complejidad de la pieza encargada.Si su comisión tiene una fecha límite específica (para un regalo de cumpleaños o alguna otra ocasión especial), esto debe discutirse antes de pagar su comisión, ya que puedo cobrar una tarifa adicional para avanzar en la cola y completar a tiempo.
Recibirá actualizaciones sobre el estado de su pieza cuando se completen etapas como el boceto, los colores base y el renderizado**. Puedes solicitar actualizaciones cuando lo desees, pero por favor ten paciencia ya que no estoy conectada a las redes sociales todo el día, todos los días.

** Esto no aplica para íconos o piezas furry simples. Debido a su sencillez y precio, no habrá actualizaciones hasta que estén listas.

IV. Satisfacción del Cliente

Haré todo lo posible para corregir los errores cometidos y ser lo más transparente posible con mis clientes sobre el proceso y el estado de su comisión.Las actualizaciones de progreso permitirán que se realicen algunas revisiones, si se solicitan:
Durante la fase de boceto, puede solicitar **hasta 2 revisiones ** gratuitas, y la tercera y posteriores incurren en una tarifa de revisión. Empezar desde cero el boceto incurrirá en una tarifa más sustancial, que puede variar según la complejidad de la pieza.
Durante la fase de coloreado y renderizado, cualquier revisión que requiera que vuelva a dibujar completamente partes del trabajo incurrirá en una tarifa de revisión. Los cambios de color y los ajustes menores serán gratuitos.

V. Uso & Copyright

Yo, Anyi, tengo todos los derechos sobre el trabajo encargado; lo que significa que yo, como titular de los derechos de autor, tengo permitido:

  • Utilizar la obra en espacios públicos con fines de autopromoción.

  • Publicar la obra en galerías públicas y redes sociales.

  • Reclamar la propiedad de la obra en sí.

  • Incluir la obra en libros de arte o paquetes que puedan venderse con fines de lucro.

  • Usar la obra para hacer merchandising como impresiones, calcomanías, etc., solo si el trabajo encargado es un fanart. Esto no se aplica a las comisiones que representan personajes originales o personas reales.

Tú, el cliente, tienes permitido:

  • Imprimir y mostrar el trabajo solo para uso personal, a menos que se acuerde lo contrario por contrato.

  • Reclamar los derechos sobre el personaje representado en la obra, pero no sobre la obra en sí.

  • Usar el trabajo para autopromoción y para publicar en espacios públicos como desees, pero solo con el debido crédito otorgado al artista original (Anyi).

El incumplimiento de estos términos de servicio dará como resultado la revocación de su licencia de uso personal del trabajo y la posible inclusión en una blacklist.Ejemplos de infracción de copyright son los siguientes:

  • Reproducir y utilizar el trabajo protegido por derechos de autor con fines comerciales sin una licencia comercial. (En pocas palabras, vender la pieza como una impresión o mercancía de cualquier manera, sin permiso).

  • Atribuirse erróneamente el mérito de la creación de la obra en sí.

  • Eliminación de marcas de agua/firmas del trabajo.

  • Crear ediciones no autorizadas del trabajo.

Las licencias comerciales se pueden proporcionar por una tarifa única de un porcentaje del costo de la comisión original en función de cómo se utilizarán.Los niveles de uso comercial y a qué se aplican son los siguientes:Uso comercial A: material promocional vinculado a fines comerciales (logos, emotes, assets para tiendas, thumbnails de YouTube, etc.)
Uso comercial B: Mercancía donde el arte no es el foco principal (portada de libro, assets de un juego, etc.)
Uso comercial C: Mercancía donde el arte es el enfoque principal (llaveros, calcomanías, diseños de camisetas, posters de eventos, etc.)Los precios para los niveles de uso comercial anteriores serán los siguientes:Uso comercial A: + %50 del total
Uso Comercial B:+ %100 del total
Uso Comercial C:+ %150 del totalPuedes enviarme un mensaje si deseas comprar los
derechos comerciales de tu encargo después de que se haya completado.Ten en cuenta que esto NO te permite reclamar crédito por el trabajo original, aún deberá acreditar al artista original (Anyi), incluso si ha sido alterado o editado de alguna manera.Como nota adicional, está expresamente prohibido convertir cualquiera de mis trabajos en NFT (non fungible tokens) u otros productos digitales similares en blockchains de criptomonedas. Una licencia de uso comercial no incluye el derecho a hacerlo.

VI. Cancelación y Reembolsos

Ten en cuenta que yo, la artista, retengo el derecho de cancelar y reembolsar el encargo en cualquier momento por una razón u otra. Siempre reembolsaré tu encargo en su totalidad (incluidas las propinas) si no puedo completarlo.Tú, el cliente, NO tienes la capacidad de cancelar o solicitar un reembolso completo una vez que hayas aceptado estas condiciones y pagado la pieza.Si el encargo aún no se ha completado después de más de tres meses, puede solicitar un reembolso sobre esa base, pero SÓLO si la imagen aún no se ha completado. Si la fase de boceto de una comisión ha sido aprobada y aprobada para pintar, solo recibirá un reembolso del 50%. Si la fase de coloreo ha sido aprobada, recibirá un reembolso del 30%. No se realizarán devoluciones por ningún motivo una vez que una pieza se considere “terminada”, es decir, se haya completado el renderizado.Cualquier reembolso se procesará cuando sea financieramente viable para mí hacerlo; incluso si apruebo una solicitud de reembolso, ten paciencia si toma tiempo.Los intentos de chargeback de PayPal significarán que perderás el derecho a su encargo, y dicho trabajo se reutilizará para otro encargo o pieza personal. El chargeback se disputará con PayPal, y serás incluide en una blacklist para no aceptar encargos en el futuro. También puedo, a mi discreción, optar por advertir a otres artistas y alentarles a que no acepten más encargos tuyos.

Para obtener información sobre precios, consulta la página **Examples and Prices **. Todos los precios están sujetos a cambios en cualquier momento y no son negociables para bajar. Estos precios son solo referenciales y el precio final dependerá de la complejidad de la pieza y de lo cerca que esté el plazo. Los precios para clientes chilenos serán calculados según el cambio vigente de USD a CLPEstos términos y condiciones se pueden ajustar según la naturaleza de la comisión y se pueden discutir a través de DMSi no deseas que el encargo se publique en las redes sociales, por favor informar con anticipación.
